for OlympicGetaways.Com Gift Certificates

The gift certificate ("Certificate") is issued by OlympicGetaways.Com, 1812 Lindsay Hill Road,Quilcene, WA 98376, in accordance with the following terms and conditions ("Terms"). These Terms constitute the entire agreement and your possession or use of this Certificate constitutes your acceptance of these Terms.

Each Certificate has a one (1) year expiration date from date of issue.

A Certificate can only be redeemed by the person to whom it was issued (the "Holder") for up to its face value in "qualifying services" at "participating businesses". To redeem this Certificate, Holder must present and surrender the complete certificate including the cover and white and yellow copies.

Participating properties and qualifying services are subject to change. Before planning to redeem a Certificate, be sure to check the then current qualifying services and then current participating properties at the OlympicGetaways.Com web site. It is always a good idea to let the business owner know you are expecting to redeem a Certificate prior to incurring any charges.

This Certificate is not refundable or redeemable for cash, but can be replaced at no cost if lost or stolen. For replacement, original purchaser must present proof of purchase to OlympicGetaways.Com and certify loss in writing.

If this Certificate is presented for qualifying services with a price of less than face value ($50, $100, or $200), this Certificate's value will not be greater than the price of the qualifying services. However, the redeeming business may, at its option, issue a credit to the Holder for use on a subsequent visit to that business, in an amount equal to the difference between the face value and the value of the qualifying services.

Holder is responsible for all taxes, duties, fees, gratuities and assessments arising out of use of this Certificate.

OlympicGetaways.Com warrants that this Certificate can be redeemed in accordance with the terms and conditions above. OlympicGetaways.Com makes no other warranty or representation, and the implied warranties of MERCHANTABILITY and FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED. IN NO EVENT SHALL OLYMPICGETAWAYS.COM BE LIABLE FOR COMPENSATORY, INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES. IF OLYMPICGETAWAYS.COM'S LIMITED WARRANTY OR LIMITATION OF LIABILITY SHALL FOR ANY REASON WHATSOEVER BE HELD UNENFORCEABLE OR INAPPLICABLE, HOLDER AGREES THAT OLYMPICGETAWAYS.COM'S LIABILITY SHALL NOT EXCEED THE SUM OF ONE U.S. DOLLAR. Because some states or jurisdictions do not allow the exclusion or limitation of implied warranties or liability, the above limitation may not apply to you.

All issues and disputes regarding these Terms, or the rights and obligations of the parties, shall be governed by the substantive laws of the State of Washington without reference to conflicts principles, and shall be determined by binding arbitration under the commercial rules of the American Arbitration Association ("AAA"), at the office of the AAA nearest OlympicGetaways.Com's principal place of business.
